Whereas the lawsuit was filed as class action on April 3, 2007 for fraud, for violations of articles of incorporation, bylaws, Corporation Code, Civil Code,  Penal Code, and Government Code against the governing body of Fremont Hindu Temple, attorney general, and other defendants.

Whereas on August 9, 2007, the Honorable Judge Bonnie Sabraw gave finding that the members of governing body did commit self-dealings and mismanaged. 

Whereas Anthony J Sperber, an attorney at law represents Fremont Hindu Temple and the Gokal Gupta and Dr. Romesh Japra.  Mr. Sperber did not file representation for other Defendants.  

Whereas Gokal Gupta for himself and for Fremont Hindu Temple and Dr. Romesh Japra, for himself filed answer to Plaintiff’s Complaint; they denied any knowledge of the elections of the year 1984; they also denied Dr. Japra’s team lost and Dr. Hari Puri’s team won the 1984 election. 

Whereas Gupta admits the first amendment of the 1984 bylaws in the original 1981 bylaws by Tej Singh with 2/3 majority not by ¾ majority as required under 1981 bylaws, in their answers and affidavit of Gupta.  They had shown 16 pages the first amendment of 1984. Dr. Ramanand Prasad produced the missing 17 page of the first amendment of the year 1984, which shows that fraud, crime, and perjury is committed in and out the court. Gupta later admitted, in the affidavit, that there was amendment, but this page 17 was misplaced in the Fremont Hindu Temple records.

Now, under section 382, 425.17 etc. of Code of Civil Procedure read with Rule 1811 etc. of California Rules of Court, Plaintiff and Interested Defendants, jointly

·        To liberate the FREMONT TEMPLE from unlawful possession, mismanagement and self-dealings by one group/individual.

·        To give temple management back to the Hindu community at large.

·        To have transparency in use and accounting of temple funds.

·        To form a brand new management system where voice of the public is heard.

·        To admit anyone interested in serving the BOARD OF DIRECTORS without paying money.

·        To set an example of management for the future generation that they can feel proud of.
